This page is used to inform website visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Site as defined in our corresponding Terms of Agreement, as well as the ForMyHealth and Kristen Lindorf Communities.


The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at formyhealth.org, unless otherwise defined in this Privacy Policy. Our Privacy Policy was created with the help of the Privacy Policy Template.


If you choose to use access and/or register our Site and/or the ForMyHealth and Kristen Lindorf Communities, then you agree to the collection and use of information in relation with this policy. The Personal Information that we collect are used for providing and improving the Service. We will not use or share your Personal Information with anyone except as described in this Privacy Policy. We collect this Personal Information about you in an effort to conduct the business activities necessary to provide the best possible quality of customer service to you. If you believe that the Personal Information we have about you is incorrect, incomplete, or inaccurate, please send a request to ask@formyhealth.org and we will amend your Personal Information according to your request. ForMyHealth and Kristen Lindorf and associated Communities reserve the right to not make requested changes if we have reasonable suspicion that there are violations to or potential fraudulent misuse of Personal Information. In the event that this happens, we will make a note in your account and determine how to best serve you and validate your identity. We collect, hold, use, and disclose your Personal Information for the following purposes:

  1. To provide our products and services to you
  2. To send and receive communications requested by you.
  3. To answer any questions and provide information and/or advice about existing and upcoming services.
  4. To grant you access to the protected areas of our website (in the event that you choose to register as an official member.
  5. To comply with laws, rules, regulation, lawful and binding determination, decision or direction of a regulator, or in cooperation with governmental authorities.


In the event that we are unable to collect your Personal Information, understand that we may not be able to provide access to our Site, products, and/or services to you to the same standard (as those whom we have the Personal Information for), or we may not be able to provide access to our Site, products, and/or services to you at all. This Log Data may include information such as your computer’s Internet Protocol ("IP") address, browser version, pages of our Service that you visit, the time and date of your visit, the time spent on those pages, and other statistics. If you participate in any discussion forums, chat rooms, webinars, groups (including but not limited to Facebook), be aware that your Persona Information may be broadly available to others potentially from users outside ForMyHealth and Kristen Lindorf Site and associated communities that may have access to that discussion, forum, or your Personal Information. Also, please recognize that forums, communities, and groups outside of ForMyHealth and Kristen Lindorf may be facilitated by a third-party, who may have additional rules and conditions associated with the use of that forum, community and group. It is your responsibility to make yourself aware of those Terms, Rules, and Policies to ensure the privacy and protection of your information.


Be advised that ForMyHealth, Kristen Lindorf, and authorized ForMyHealth representatives reserve the right to record forums, live events, and webinars, as well as reproduce those recordings non-exclusively and in any format as outlined in our Terms of Agreement. By signing up or choosing to participate in any of these events or programs, you acknowledge that we may take, store, and share these recordings for future meetings, webinars, forums, live events at the direction of Kristen Lindorf. If you do not wish to be included in these recordings, it is your responsibility to choose to leave the forum, event, webinar, or other associated program.


What do ForMyHealth and Kristen Lindorf do with my information?


Personal Information may be disclosed to the following parties:

  1. Employees, contractors, or other service providers associated with ForMyHealth and Kristen Lindorf for the purposes of business and website operations, in an effort to fulfill requests by you, and to otherwise provide our products and services to you. Please note that this may include our web hosting providers, IT systems administrators, mailing houses, couriers, payment processors, data entry service providers, electronic network administrators, debt collectors, and professional advisors such as accountants, solicitors, business advisors, and consultants.
  2. Suppliers and other third parties with whom we have commercial relationships for any business, marketing, or other related purposes.
  3. Organizations that you have authorized or requested us to share this information with via written request.
  4. Please note that any Personal Information disclosed to a third party will require agreement to the standards of our Privacy Policy by that third party.

In the event that the business is sold, transferred, or control over the business has been handed to an authorized representative, we reserve the right to transfer to the extent legally permissible, our user database. This may include Personal and non-Personal information that is contained within that database. It may also be disclosed to a potential purchaser of this business in the evaluation of the purchase. This would only be disclosed in good faith, with the agreement that the Privacy Policy should be followed by all parties involved.


Children’s Privacy


Our Site and the ForMyHealth and/or Kristen Lindorf Communities are not intended for anyone under the age of 18. We do not knowingly collect personal identifiable information from children under 18. In the case we discover that a child under 18 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.


Changes to This Privacy Policy


We may update our Privacy Policy from time to time. Thus, we advise you to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately, after they are posted on this page.


Marketing


ForMyHealth and Kristen Lindorf may send you information regarding our products, services, and associated communities that may be of interest to you. This may be sent in email, SMS, and through the postal service. If you prefer not to participate or receive this information, please update your user account and opt-out of receiving marketing communications from us. You may also send an email to ask@formyhealth.org to request to opt out as well. At that time, we will endeavor to suspend further information being sent to you. Please note that processing this request may take some time, and that information that has been scheduled or has already been sent out, may not be intercepted and may still be delivered to you. 


If you wish to withdraw your consent to this privacy policy and any collection and retention of your data, please contact us at ask@formyhealth.org and we will arrange for your data to be deleted insomuch as we are able to maintain good legal standing and tax requirements. Additionally, if you choose to withdraw your consent, including the collection and retention of your data, ForMyHealth, Kristen Lindorf, and associated communities reserves the right to limit the use of our Site, products, and services, or discontinue them as necessary as most of it is tailored for your specific use and without your Personal Information, we cannot guarantee the quality of your experiences associated with our business. Our representation heavily weighs on the ability to tailor the Site, products and services based on Personal Information. 


Breach of this Policy


If you believe your privacy has been breached, please immediately contact us at ask@formyhealth.org. We will contact you within a reasonable time to discuss your concerns and together with you, determine possible options and remedies for the situation. We will do our best to ensure your complaint is resolved in a reasonable, timely, and appropriate manner.

For My Health is not an official medical establishment and is therefore not currently regulated by HIPAA. However, policy and procedure will align with HIPAA procedure as follows:


HIPAA PRIVACY PROGRAM POLICY/PROCEDURE FOR PRIVACY OFFICER

  1. Purpose

To comply with the Administrative Safeguards of HIPAA Privacy, to secure and maintain the confidentiality of Protected Health Information, maintain sensitive organizational information at For My Healthand prevent and detect inappropriate and illegal uses and disclosures.

Policy:

For My Health shall be responsible for implementation of the administrative requirements under the Federal HIPAA Privacy Rule.

For My Health will designate a privacy official to be responsible for the development and implementation of the policies and procedures of For My Health.

3. Definitions:

a. HIPAA: Health Insurance Portability and Accountability Act of 1996.

b. Individually Identifiable Health Information (IIHI): Under Section 160.103 of HIPAA, IIHI is defined as information that is a subset of health information, including demographic information collected from an individual, and:

i. Is created or received by a health care provider, health plan, employer, or health care clearinghouse.

ii. Relates to the past, present, or future physical or mental health or condition of an individual; the provision of health care to an individual; or the past, present, or future payment for the provision of health care to an individual.

iii. That identifies the individual.

iv. With respect to which there is a reasonable basis to believe the information can be used to identify the individual.

v. IIHI includes identifiers of the patient, relatives, employers, or household members such as the following (§164.514):

1. Names.

2. Geographic subdivisions smaller than a State, including street address, city, county, precinct, zip code (except for the initial 3 digits of a zip code if, according to the current publicly available data from the Bureaus of the Census all zip codes with the same 3 initial digits contains more than 20,000 people).

3. All elements of dates (except year) directly related to an individual, including birth date, admission date, discharge date, date of death, all ages over 89 and all elements of dates indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older.

4. Telephone numbers.

5. Fax numbers.

6. Email addresses.

7. Social security numbers.

8. Medical record numbers.

9. Health plan beneficiary numbers.

10. Account numbers.

11. Certificate/license numbers.

12. Vehicle identifiers and serial numbers, including license plate numbers.

13. Device identifiers and serial numbers.

14. Biometric identifiers, including finger and voice prints.

15. Full face photographic images and any comparable images.

16. Any other unique identifying number, characteristic, or code.

c. Protected Health Information (PHI): Under Section 164.501 of HIPAA, PHI means IIHI that is transmitted and maintained in electronic media or in any other form or medium.

d. Designated Record Set: In compliance with §164.524 contained within the Privacy Rule of the Administrative Simplification provisions of HIPAA, For My Health maintains a designated record set (DRS). The designated record set includes medical and billing records that patients and/or their personal representatives have the right to access, inspect, and copy. Records include any item, collection, or grouping of information that includes PHI and is maintained, collected, used, or disseminated by or for a provider (§164.501).

e. Individual: For purposes of HIPAA, an individual is the patient and his/her legal Personal Representative (§164.502(g)).

f. Personal Representative: A person, who under law, has the authority to act on behalf of a patient in making decisions related to health care (i.e. a parent, guardian, or legal custodian). Personal Representatives may have access to and/or request amendment of PHI relevant to their representative capacity unless there is a reasonable belief that the patient has been or may be subjected to domestic violence, abuse, or neglect by such person, the release could endanger the patient, or in the exercise of professional judgment it is decided that it is not in the best interest of the patient to treat the person as the patient’s personal representative [§164.502(g)].

g. Treatment: The provision, coordination, or management of health care and related services, including the coordination or management of health care by a health care provider with a third party; consultation between health care providers relating to a patient; or the referral of a patient for health care from one health care provider to another (§164.501).

h. Payment: Activities undertaken by For My Health to obtain or provide reimbursement for the provision of health care. Activities for payment include eligibility of coverage determination, billing, claims management, collection activities, utilization review including precertification, preauthorization, concurrent, and retrospective review of services, and specified disclosures to consumer reporting agencies (§164.501).

i. Health Care Operations: Quality assessment and improvement activities; reviewing the competence, qualifications, performance of health care professionals, conducting training programs, accreditation, certification, licensing, credentialing, underwriting, premium rating, and other activities relating to the creation, renewal, or replacement of a contract of health insurance or health benefits; conducting or arranging for medical review, legal services, and audition functions; business planning and development; business management (§164.501).

j. Provider: Under Section 160.103 of HIPAA, a provider of medical or health services (as defined in section 1861(u) of the Act, 42 U.S.C. 1395x(u) and 1861(s) of the Act, 42 U.S.C. 1395x(s)) and any other person or organization who furnishes, bills, or is paid for health care in the normal course of business. Providers are those contracted, subcontracted, or employed by For My Health who provide services on behalf of For My Health.

4. Procedures:

a) For My Health is committed to complying with the HIPAA Privacy Rule and maintaining the confidentiality of patients’ PHI through appropriate, authorized access, uses, and disclosures.

b) For My Health and its business affiliates create, store, maintain, use, transmit, collect and disseminate PHI in an environment that promotes confidentiality and integrity without compromising PHI.

c) Confidentiality policies and procedures are reinforced throughout For My Health and followed by all physicians, employees, and business associates.

d) The HIPAA Privacy Officer at For My Health oversees the HIPAA Privacy program.

e) The HIPAA Privacy Officer at For My Health responsible for the following functions which support compliance with the HIPAA Privacy Rule, patient confidentiality, access laws and For My Health policies and procedures pertaining to them:

i) Maintain working knowledge of legislative and regulatory initiatives. Interpret and translate requirements for implementation.

ii) Establish and maintain written policies and procedures that place appropriate administrative, technical, and physical safeguards to protect the privacy of PHI from intentional or unintentional uses and disclosures.

(1) Update policies and procedures as necessary and appropriate, and in compliance with For My Health Notice of Privacy Practices, to comply with changes in the law.

(2) Make necessary changes to For My Health Notice of Privacy Practices.

(3) Maintain policies and procedures (including any changes made) in written or electronic form for six years from the date of its creation or the date when it last was in effect, whichever is later.

(4) Make all reasonable efforts to limit incidental uses and disclosures.

(5) Provide training, for anyone coming into contact with PHI, on the established policies and procedures as necessary and appropriate to carry out their job functions and document the training provided.

(a) To each employee by no later than the compliance date for all employees].

(b) To new employees during their first month of employment.

(c) To existing employees annually.

(d) To existing employees whose functions are affected by a change in the policies and procedures, within a month after the change comes into effect.

(6) Maintain a program encouraging employees and patients to report complaints concerning compliance of the law and For My Health policies and procedures to For My Health Officer.

(7) Promptly and properly investigate and address reported violations, taking steps to prevent recurrence in a timely manner.

(8) Document all complaints and follow up documentation [§164.530(d)(2)].

(9) Assure there will be no intimidation, threats, coercion, discrimination against, or any other retaliatory action as a consequence to anyone who makes reports or participates in an investigation of violations in good faith [§164.530(g)].

(10) Mitigate, to the extent practicable, any harmful effect that is known to For My Health of a use or disclosure of PHI in violation of its policies and procedures or the requirements of the law by For My Health or its business associate [§164.530(f)].

(11) Consistently enforce the law and For My Health policies and procedures through appropriate disciplinary mechanisms [§164.530(e)].

(12) Document and file all actions taken against employees who failed to comply with the policies and procedures [§164.530(e)(2)].

(13) Monitor, audit, and reinforce compliance with the law and For My Health policies and procedures.

(14) Cooperate with the Office of Civil Rights, other legal entities, and organization officers in any compliance reviews or investigations.

(15) Provide assistance to patients and employees about the law and For My Health policies and procedures [§164.530(a)(1)(ii)].

(16) Ensure that there are no attempts to require individuals to waive their legal rights as a condition of the provision of treatment or payment [§164.530(h)].

(17) Implement, Distribute and Maintain the Notice of Privacy Practices [§164.520(a-e)].

(a) Maintain a copy of the Notice (including changes made) for six years from the date when it was last in effect.

(b) Update the Notice to reflect changes in the law or For My Health policies and procedures.

(c) Distribute the Notice.

(d) Direct questions regarding the Notice to For My Health HIPAA Privacy Officer.

(18) For My Health will implement, monitor and maintain Business Associate Agreements with affiliate business entities when required by law.

2) Documentation:

a) All documentation related to and/or required by HIPAA, including but not limited to compliance enforcement activities such as training, policies and procedures, complaint investigations, designated record sets, etc. are maintained for six years from the date of creation, or the date it was last in effect, whichever is later [§164.530(j)]. Documentation may be maintained in written or electronic form [§164.530(j)(1)(ii)].
